Abstract

Abstract: Women’s Testimony in View of ‘Ulamâ’ of Tafsîr. Within Islamic law, the testimony of women is controversial. There are those who distinguish between female witnesses and males in matters such as debts, but there also those who equate the two. The difference appears to have resulted from the difference in points of view. Actually when differentiated between al-ishhâd (out of court testimony) and al-shahâdah (testimony) as evidence brought before a judge in court, does not need to distinguish between the testimonies of women and men. Shahâdah in court is determined by the judges, as drawn out by the Prophet and accepting the testimony of a woman in the case of rape. Similarly, the Prophet accepted the testimony of a woman in the case of ‘Uqbah ibn al-Harîth who married Umm Yahyâ bint Abî Lahab.Keywords: al-ishhâd, al-shahâdah, shâhidayn, debtsAbstrak: Kesaksian Wanita dalam Pandangan Ulama Tafsir. Dalam hukum Islam, terjadi kontroversi tentang kesaksian perempuan. Ada yang membedakan antara saksi perempuan dengan laki-laki seperti dalam masalah utang- piutang, tapi ada juga yang menyamakan antara keduanya. Perbedaan tersebut tampaknya diakibatkan oleh perbedaan sudut pandang. Sebenarnya bila dibedakan antara al-ishhâd (memberi kesaksian di luar pengadilan) dan al-shahâdah (persaksian) sebagai alat bukti di depan hakim di pengadilan, tidak perlu membedakan antara kesaksian perempuan dan laki-laki. Shahâdah di pengadilan ditentukan oleh keyakinan hakim, sebagaimana dicontohkan oleh Nabi dengan menerima kesaksian seorang perempuan dalam kasus pemerkosaan. Begitu juga Nabi menerima kesaksian seorang perempuan dalam kasus ‘Uqbah ibn al-Harîth yang mengawini Umm Yahyâ bint Abî Lahab.Kata Kunci: al-ishhâd, al-shahâdah, shâhidayn, utang-piutang.DOI: 10.15408/ajis.v13i2.942

Abstract

Abstract: Fiqh for Minorities: a Theoretical Study. Fiqh for Minorities—which in Arabic is called Fiqh al-Aqaliyyât— is a fiqh model that maintains legal association of sharia and the dimensions of a particular community, namely minority Muslim communities in western countries. Fiqh for Minorities is a product of reinterpretation of the existing arguments on the basis of the benefit whichis the spirit of sharia. The designers of this fiqh are Taha Jabir al-’Alwani in his book, Toward a Fiqh for Minorities: Some Basic Reflection, and Yûsuf al-Qarâdawî in his book, Fî Fiqh al-Aqalliyât al- Muslimah. Fiqh for Minorities originated from the accumulation of the concerns of Muslim minority communities in western countries when it should be doing something related to their religion. This fiqh is designed to provide guidance and a handle on the things that are prohibited and permissible for Muslim minorities living in western countries to carry out their obligations as a Muslim.Keywords: fiqh, minority, shariaAbstrak: Fikih Minoritas: Suatu Kajian Teoretis. Fikih minoritas—yang dalam bahasa Arab disebut dengan Fiqh al- Aqalliyât—merupakan model fikih yang memelihara keterkaitan hukum shar‘î dengan dimensi-dimensi suatu komunitas tertentu, yaitu masyarakat minoritas Muslim di Barat. Fikih minoritas adalah sebuah produk hasil reinterpretasi atas dalil-dalil atas dasar kemaslahatan yang memang menjadi spirit syariah. Penggagas fikih ini adalah Tâhâ Jâbir al- ‘Alwânî dalam bukunya, Toward a Fiqh for Minorities: Some Basic Reflection dan Yûsuf al-Qarâdawî dalam bukunya, Fî Fiqh al-Aqalliyât al-Muslimah. Fikh minoritas lahir berawal dari akumulasi kegelisahan masyarakat minoritas Muslim di Barat ketika harus melakukan sesuatu yang berkaitan dengan keagamaan mereka. Abstract

Abstract: The Relationship of Religion and State within the Context of Political Modernisation in the Reform Era. Political modernization in Indonesia to some extent has brought about political secularization. Yet, in the Pancasila state, the process will not lead to a secular state. The relationship between religion and the state is an intersectional relationship, neither fully integrated nor completely separate. In the reform era, democratic political modernization has implications on the emergence of new political parties, including Islamic parties. On the other hand, the freedom of expression in certain cases has led to disputes and conflicts that can disrupt social harmony and national integration. In this context, religion can provide a positive contribution as an integrative factor that values social diversity, and not as a disintegrative factor that supports social exclusivism.Keywords: political modernization, secularization, religion and public policy, religion, religion and political participation, religion and national integrationAbstrak: Hubungan Agama dan Negara dalam Konteks Modernisasi Politik di Era Reformasi. Modernisasi politik di Indonesia dalam tingkat tertentu telah menimbulkan sekularisasi politik. Namun, di negara yang berideologi Pancasila ini, proses itu tidak akan mengarah kepada negara sekuler. Hubungan antara agama dan negara adalah hubungan persinggungan, tidak sepenuhnya terintegrasi dan tidak pula sepenuhnya terpisah. Di era reformasi ini, modernisasi politik yang demokratis beri mplikasi kepada munculnya partai-partai politik baru, termasuk partai-partai Islam. Di sisi lain, ekspresi kebebas an dalam kasus-kasus tertentu telah menimbulkan perselisihan dan konflik yang bisa mengganggu harmoni sosial dan integrasi bangsa. Abstract

Abstract: An Evaluation Study on Haji Bridging Funds of Shariah Banking Products in Indonesia. Hajj bridging funds are one of the financing products of Islamic banking based on a fatwa of the National Shariah Council that was endorsed by the Ijtimak Ulama of Fatwâ Commission throughout Indonesia. The bridging funds are to be provided to the customers who are able to settle up the loan before the hajj. Different transactions are used in hajj bridging funds. There are transactions of ijârah, qard, or both. Hajj bridging funds provide a positive impact (maslahah) like the ease for customers to obtain the hajj departure portion. However, the disadvantage (mafsadah) of hajj bridging funds are the increasing waste of the criteria of ability (istitâ‘ah) in hajj and the extending of hajj departure waiting lists.Keywords: hajj bailout, istitâ‘ah, maslahah, transaction of ijârah, transaction of qardAbstraks: Studi Evaluasi atas Dana Talangan Haji Produk Perbankan Syariah di Indonesia. Dana talangan haji merupakan salah satu produk pembiayaan perbankan syariah yang berlandaskan fatwa Dewan Syariah Nasional yang diperkuat oleh Ijtimak Ulama Komisi Fatwa seluruh Indonesia. Dana talangan haji diberikan kepada nasabah yang mampu melunasinya sebelum melaksanakan ibadah haji. Akad yang digunakan dalam talangan haji berbeda-beda. Ada yang menggunakan akad ijârah, qard, dan gabungan keduanya. Dana talangan haji memberikan dampak positif (maslahah) berupa adanya kemudahan kepada nasabah untuk mendapatkan porsi keberangkatan haji. Abstract: Support Payments of Career Woman within the Perspective of Classical Fiqh. This article attempts to research the right to support payments of career woman or woman in work. In traditional classic fiqh, the husband is liable to provide for support payments to his wife based on the principle of separation of property between husband and wife. This principle follows a flow of thought that a husband earns money instead of the wife. The understanding of the working wife or career woman which must be made dependent to the husband’s permission needs to be re-examined or reviewed because the scholars have not mentioned the obvious arguments concerning the matter. Likewise, no proposition exists which prohibits, either men or women, to work as well as no firm proposition about the need to have the husband’s permission to go to work. Similarly, many historical facts reveal that there were working women or career women in the time of the Prophet, such as ‘A’ishah, Ummu Mubâshir, and others.Keywords: support payments (living support), career woman, nushûzAbstrak: Nafkah Wanita Karier dalam Pespektif Fikih Klasik. Artikel ini mencoba meneliti tentang hak nafkah wanita karier atau perempuan yang bekerja. Dalam tradisi fikih klasik, suami berkewajiban memberikan nafkah kepada istrinya didasarkan pada prinsip pemisahan harta antara suami dan istri. Prinsip ini mengikuti alur pikir bahwa suami adalah pencari rezeki, sedangkan istri bukan pencari rezeki. Pemahaman istri bekerja atau wanita karier yang harus digantungkan kepada izin suami itu perlu dibaca ulang atau ditinjau kembali karena ulama tidak menyebutkan dalil yang jelas tentang hal itu. Dan juga tidak adanya dalil yang melarang, baik laki-laki maupun perempuan, untuk bekerja serta tidak ada dalil yang tegas tentang keharusan bekerja dengan izin suami. Begitu juga banyaknya fakta sejarah yang mengungkapkan wanita-wanita yang bekerja atau wanita karier di masa Nabi, seperti ‘Â’ishah, Ummu Mubâshir, dan lain-lain.Kata Kunci: nafkah, wanita karier, nusyu (nushûz)DOI: 10.15408/ajis.v13i2.933

Abstract

Abstract: Constructing a Political Theory af Islamic Law in Indonesia. This study confirms that the transformation of Islamic law into national law has no correlation with the struggle towards an Islamic country or Islam as the foundation of the state. Islamic law legislation are regulations that have a positive contribution to strengthening the commitment of Muslims towards the Indonesian nation-state. This study refutes the notion that the accommodation of Islamic law within legislation is an agenda aiming towards an Islamic state. The process of accommodation of Islamic law does not need to be feared, because the process is supported by the power of cultural Islam. Besides, Islamic law is at the legal source level so that the accommodation into pre-legislation undergoesstringent testing in order to always be in accordance with Pancasila and the 1945 Constitution.Keywords: politic law, legislation, Islamic law, constitutional theory and the theory of accommodationAbstrak: Membangun Teori Politik Hukum Islam di Indonesia. Studi ini menegaskan bahwa transformasi hukum Islam ke dalam hukum nasional tidak memiliki hubungan dengan perjuangan menuju negara Islam atau Islam sebagai dasar negara. Legislasi hukum Islam menjadi perundang-undangan memiliki kontribusi positif dalam memperkuat komitmen umat Islam terhadap negara kebangsaan Indonesia. Studi ini membantah pendapat yang menyatakan bahwa akomodasi hukum Islam oleh peraturan perundang-undangan merupakan agenda menuju negara Islam. Proses akomodasi hukum Islam tidak perlu dikhawatirkan karena proses itu didorong oleh kekuatan Islam kultural. Abstract

Abstract: Unification of the Islamic Calendar: A Dialogue on Wujûd al-Hilâl and the Visibility of Hilâl. Within the vocabulary of the Islamic calendar, particularly in Indonesia, the terms al-Hilâl and the sighting or “visibility” of the hilal (imkân al-ru’yah) are recognised. Wujûd al-hilâl is a creative synthesis or half way between ijtimâ’ (qabl al-ghurûb) and the theory of the visibility of the hilâl or, in other words, half way between pure hisab (calculating the hilâl) and ru’yah (the sighting of hilâl). Therefore, for the theory of wujûd al-hilâl, the method used in starting the first day and a new month on the Islamic calendar is not merely the process of the occurrence of astronomical conjunctions but also considering the position of hilâl at sunset. Meanwhile, the visibility of hilâl is a construction of theories that which are sourced from the experience of observers. As a result, various typologies are created. In order to unite both concepts, an assertive and continuous dialogue is required.Keywords: hilâl, hisâb, ru’yah, matla‘Abstrak: Penyatuan Kalender Islam: Mendialogkan Wujûd al-Hilâl dan Visibilitas Hilal. Dalam khazanah pemikiran kalender Islam, khususnya di Indonesia, dikenal istilah wujûd al-hilâl dan visibilitas hilal (imkân al-ru’yah). Kehadiran wujûd al-hilâl merupakan sintesis kreatif atau jalan tengah antara teori ijtimâ‘ (qabl al-ghurûb) dan teori visibilitas hilal atau jalan tengah antara hisab murni dan rukyat murni. Oleh karena itu, bagi teori wujûd al-hilâl metode yang digunakan dalam memulai tanggal satu bulan baru pada kalender Islam tidak semata-mata proses terjadinya konjungsi tetapi juga mempertimbangkan posisi hilal saat matahari terbenam. Sementara itu visibilitas hilal adalah bangunan teori yang bersumber dari pengalaman para pengamat. Sehingga melahirkan bermacam-macam tipologi. Abstract: The Contribution of Funding Shariah Banking to Developing Micro, Small, and Medium Enterprises Inority Jurisprudence. The characteristics of Islamic banking are different to conventional banking, because Islamic banking based on the core products of for results which developed into mushârakah and mudârabah financing products. Thus, the existence of Islamic bank should provide large contributions toward real sector development. One enterprise unit that needs to be developed to support real sector development is Micro Small and Medium Enterprises (MSMEs) in the current national economy havinga very important position, because of its contribution in employment and Gross Domestic Product (GDP), as well as flexibility and strength in the face of economic crisis.Keywords: Islamic fund, Micro, Small, and Medium Enterprises (MSMEs)Abstrak: Konstribusi Pembiayaan Perbankan Syariah terhadap Pengembangan Usaha Mikro, Kecil, dan Menengah. Karakteristik perbankan syariah berbeda dengan perbankan yang berdasarkan sistem bunga, karena perbankan syariah didasarkan pada core product pembiayaan bagi hasil yang dikembangkan dalam produk pembiayaan mushârakah dan mudârabah. Dengan demikian, kehadiran perbankan syariah seharusnya memberikan dampak yang besar terhadap pertumbuhan sektor riil. Abstract

Abstract: Analysis of a Text and Context Approach within the Formulation of Islamic Inheritance Distributions. For about fourteen centuries Islamic inheritance law has always been regarded as a qat‘î doctrine which covers for ijtihad and should be taken for granted. However, changes and developments over time, the existence of Islamic inheritance in the Quran have started to be claimed. To some liberalists and feminist activists, the law on Islamic inheritance is a product of salaf scholars to be regarded as rules that tend to be discriminative—just like the discrediting and prejudicing the rights of women—and not oriented towards human justice. Therefore, the provisions of Islamic inheritance need to be reviewed, even deconstructed by considering the social development of society.Keywords: Islamic law, justice, inheritance, tafsîrAbstraksi: Analisis Pendekatan Teks dan Konteks dalam Penentuan Pembagian Waris Islam. Namun seiring perubahan dan perkembangan zaman, eksistensi hukum kewarisan Islam dalam Alquran mulai digugat. Oleh sebagian pemikir liberal dan aktivis feminisme, hukum kewarisan Islam produk ulama salaf dianggap sebagai aturan yang cenderung diskriminatif—semisal mendiskreditkan dan merugikan hak-hak perempuan—dan tidak berorientasi pada keadilan manusia. Abstract: Transformation of Islamic Law within the Form of al-Qânûn al-Duwalî. International law (al-qânûn al-duwalî) is inter-country or inter-nation law that shows the complex principles and rules which regulate the intercommunity relationships of nations or states and international law issues are not apart from the religion professed by the people in the world. One of them is Islam, whose source of basic rules from Alquran and Hadith have greatly provided guidance of state law such as ethics of war, concept of dâr al-Islâm and dâr al-harb. Religion, state and law will unite to form concentric circles as one entity that is closely related to one another. Hukum internasional (al-qânûn al-duwalî) adalah hukum antarnegara atau antarbangsa yang menunjukkan pada kompleks asas dan kaidah yang mengatur hubungan antarmasyarakat bangsa-bangsa atau negara, dan permasalahan hukum internasional tidak terlepas pula dari ajaran agama yang dianut oleh masyarakat di dunia. Salah satunya adalah agama Islam, yang sumber ajaran pokoknya dari Alquran dan Hadis telah banyak memberikan pedoman hukum bernegara, seperti: etika perang, konsep dâr al-Islâm, dan dâr al-harb. Agama, negara, dan hukum akan bersatu membentuk lingkaran konsentris sebagai satu kesatuan yang berhubungan erat dengan satu sama lain.
